In this post, we will talk about Abhi, an expert in cybersecurity, who got his I-140 for an EB-2 National Interest Waiver (NIW) green card approved in just two weeks. 

We will look into how he did this, how he showed his endeavor is important for America, how he showed he’s qualified, and his advice for others planning to go through this process.

Abhi’s Background and Skills

Abhi got his Master’s degree in Cybersecurity in the United States in 2016. Soon after, he started working as security engineer for different tech companies in the San Francisco area, acquiring more skills and knowledge. He had also worked in that field in his home country of Nepal before coming to the US, so he had over eight years of experience in cybersecurity at the time of filing. In the sections immediately below we will look at how he argued his adherence to the Matter of Dhanasar prongs.

Prong 1: Substantial Merit and National Importance

Why Cybersecurity is important for the United States

To put together his application successfully, Abhi had to show that cybersecurity and his endevor specifically, is crucial for America. He did this by describing the plans of the U.S. government, the President’s speeches, and new rules and policies from public agencies. He pointed out that the U.S. government is going to invest more in cybersecurity in the coming years. Abhi also talked about how cyber-attacks can affect companies, and eventually the country’s economy and national security.

Prong 2: Well positioned to advance the proposed endeavor

Showcasing his skills and achievements in Cybersecurity

Abhi had to prove that he has special skills in cybersecurity, above average compared to other peers. Here, he used the exceptional ability criteria list from USCIS to guide him in putting together his argument for prong 2. Even without a Ph.D., articles, or citations, he managed to make his case strong to win the EB2 NIW green card. He talked about his successes, like taking part in special professional competitions and getting grants from private companies for his superior expertise. 

Abhi also wrote blog posts that were picked up by a very prominent news media organization like Business Insider; so he could show to USCIS his relevance in the field through those media appearances. He also showed that he earns more than others in his field in his geographical area, which USCIS can see as a recognition from the field for his exceptional expertise.

Having a Good Professional and Business Plan

In Abhi’s green card application, he included a well-thought-out business plan. The central idea of his professional plan was to plan to discover and research new types of cybersecurity risks and vulnerabilities and figure out ways to fix them. He also talked about personal development like continue attending and speaking at professional conferences or growing his personal brand. 

He proposed to offer his services to government entities as well as private companies on a contract basis. That way he would not be limited to just one organization, which would make the National Interest Waiver an appropriate choice for him, compared to getting a regular employment-based green card tied to a single employer. Additionally, this plan shows the potential that his work and endeavor have to impact the field more broadly, beyond a company.

Working with Lawyers for EB2 NIW: Abhi’s experience

Abhi worked with immigration lawyers during his green card process. The lawyers provided a template for him to supply all the necessary information and writing most of the content that would then go to the final documents. The lawyers mainly focused on checking and editing the application to make sure it was in line with the rules of the U.S. immigration service. 

Abhi mentioned that if an applicant has the drive and the time to take care of the whole process, they can try that. Hiring a lawyer is a deep personal decision that will depend on multiple factors, including the petitioner’s financial situation (immigration attorneys are very expensive).

Abhi’s special case: concurrent Adjustment of Status

Recently, there is a backlog in the EB-2 green card category, which makes concurrent I-140 and I-485 filing not possible to new applicants. We have even seen retrogression in the Visa Bulletin! However, Abhi was able to file concurrently because of his unique situation. Abhi benefited from the so-called priority date portability, from a previous I-140 application to his EB2 NIW petition. A previous employer had started a green card process, so he could use his earlier priority date and claim his right to file adjustment of status. An interesting and effective way of bypassing months of wait!

Harnessing Resources and Strategies for a Successful NIW Application

Abby leveraged various resources to understand the NIW process better. These included the USCIS website, past denied cases, artificial intelligence chatbots such as ChatGPT, YouTube channels, and free evaluation reports from immigration lawyers. Abby’s journey is an excellent example of how crucial it is to educate oneself and understand the application process.

Abhi´s tips to EB2 NIW petitioners

  • Focus on Proving Exceptional Ability: To meet the second prong of the NIW requirements, demonstrate exceptional ability in your field. Identify the criteria relevant to your area of expertise and work towards meeting as many of them as possible. Emphasize your accomplishments, contributions, and impact in your field.
  • Be Creative and Strengthen Your Profile: Depending on your field, find ways to strengthen your profile over time. Publish papers, secure relevant certifications, participate in projects, or join professional societies.
  • Continuously work on improving your qualifications and impact.
  • Utilize Available Resources: Take advantage of resources such as USCIS websites, artifial intelligence chats, and YouTube channels dedicated to immigration topics. These resources can provide valuable insights, explanations, and examples to help you navigate the application process effectively.
  • Learn from Denied Cases: Study past denied cases to identify common mistakes and weaknesses in applications. By understanding what to avoid, you can strengthen your own application and increase your chances of success. You can find denied cases in the AAO (Administrative Appeals Office) website.
  • Consider the Long-Term Plan: If you don’t currently meet all the requirements for an NIW application, don’t get discouraged. Assess what aspects of your profile you can work on to meet the criteria in the future. Develop a long-term plan to improve your qualifications and maximize your chances of success.

Azzez’s story is one of a Do-It-Yourself man. He clearly has no fear about taking his matters into his own hands. And he did exactly that with his immigration future, when he decided to apply for an EB2 NIW green card all by himself. 

He used online resources, such as the USCIS website and my YouTube channel, to educate himself about this process. Then he put together his own petition and succeeded. And all of this while he works on his doctoral dissertation!

Azeez’s background – a Civil Engineer pursuing a PhD

Azeez is originally from Nigeria, where he obtained his undergraduate degree in Civil Engineering. He worked for 2 and a half years. Then, seeking new opportunities, particularly in higher education, he moved to the US. In 2019 he started his MS in Civil Engineering the States. After completing his masters, he moved to a different University to pursue his PhD. He started his doctoral studies in 2021, so he is currently two years in.

Azeez Do-It-Yourself (DIY) approach to EB2 NIW

In 2020 Azeez first heard about this type of permanent residency status that allows you to self petition. Until then, he had only heard about marriage-based green cards, or visas such as the popular H-1B option for foreign skilled workers. It wasn’t until last year, 2022, when he found my YouTube channel, and with that, other channels and most especially, the USCIS resources, he decided to be serious about his green card petition. He contacted lawyers but they declined to take his case. Azeez did not let these responses demotivate him and he continued his path as a DIY applicant. Time proved him right! He downloaded my very own I-140 petition from this website to help him understand how to craft a successful application for his case.

Azeez’s strategy for the EB-2 NIW petition

General EB-2 requirement

Azeez holds a Master degree in Civil Engineering so he qualifies as a professional holding an Advanced Degree. If he didn’t qualify he would be forced to use the Exceptional Ability route instead.

Prong #1: The proposed endeavor has Substantial Merit and National Importance

Azeez’s research focuses on improving transportation infrastructure in America, which is tightly linked to the US economy because of movement of people and freights, and also to national safety.
To argue his case and provide evidence of the national improtance of his endeavor, Azeez used official government documents such as White House or Congress publications. In my conversation with him he specifically mentioned the bipartisan infrastructure bill from 2021, and a report from the American Society of Civil Engineers.

Prong #2: Well-positioned to advance the proposed endeavor

For this prong, Azeez used different types of evidence, among which 3 out of 5 criteria for exceptional ability.
 
  • Awards, scholarships, certifications. 
  • Four scientific publications. He mentioned they were not so well cited but he could argue that the reason was how recent they were.
  • Letters of recommendation. He had 3 independent letters and 5 subjective letters.

His timeline for EB-2 NIW

Below are key dates on his success story case:
  • I-140 filing date (without premium processing): November 2022 (priority date of December 2)
  • I-140 approval date: mid February, 2023
To summarize, Azeez received approval for his I-140 in approximately 2 months and a half without using Premium Processing.
 

Next step: adjustment of status

Azeez received a priority date of December 2. This is unfortunate because the Visa Bulletin has been frozen since then until the time of writing this post (March 2023). Once his date becomes current, he will be able to file his petition to adjust status with USCIS and finish the process. In Azeez’s particular case, this is not the end of the world, because he has a valid J visa to continue his doctoral studies.

Azeez’s advice to others

During my chat with Azeez he provided incredibly helpful advice to other DIY petitioners:

  1. Take advantage of online resources. Right now there is a lot of information about this green card category, and you can leverage all that knowledge to your case’s advantage!
  2. Do not believe all the myths about EB2 NIW, like needing one hundred publications or five hundred citations.
  3. It takes time and effort to put together a successful EB2 NIW application. It took Azeez 3 months of actively working on his petition.

Mohamed's EB2 NIW success story

Mohamed is a financial expert from Egypt. He has over a decade of experience in big projects supporting the industry. This article is a summary of the conversation I had with him for my YouTube channel. In the interview, I asked him about his profile, his proposed endeavor for the United States, what type of evidence he used, his timeline and what advice he has to offer for others in a similar journey.

I do not know Mohamed personally, he sent me an email once he received his I-140 approval this week. Mohamed’s background – a business and finance professional

Mohamed graduated in 2006 in Egypt, where he was in the top 10 in his University class. He worked in government first, and then decided to move to Dubai in a small company in the private sector. Looking for better opportunities, in 2011 he joined a bigger company in the automotive and industrial field in the Jebel Ali Free Zone. He resigned from this position ten years later, in 2021, when he decided it was time for an American adventure. In this bigger company, though, Mohamed found the opportunities he had been looking for, as he obtained several promotions, from Senior accountant, to Finance Manager, to Finance Director.

Mohamed’s visa status: a special case

He entered the US under a visitor visa (B1/B2). This is a visa with nonimmigrant intent, so one must be careful when filing immigrant petitions. For example, now that Mohamed’s petition has been approved, he must make sure that he complies with the 90-day rule. Even though this rule is no longer in effect formally, it is still seen as a guideline by the authorities. USCIS would probably decline Mohamed’s adjustment of status application if he files for it before 90 days have passed since he entered the country. After 90 days in the US, the USCIS consider that even though he entered with nonimmigrant intent, “life happens” and they acknowledge that the applicant’s situation may have changed, therefore being a bit more permissible in accepting the adjustment of status.

How Mohamed prepared himself for EB2 NIW application

In the interview, Mohamed explained that he watched a lot of the videos out of my YouTube channel. In fact, when he arrived to the US he was unaware of this EB2 NIW green card path that he could use. Through the videos, he got to know this National Interest Waiver, understood the requirements, and realized he could apply. He mentioned that a few lawyers he had contacted offered other solutions but no one mentioned the route he ultimately took. Later, he downloaded my EB-2 NIW petition and learned how a successful case was put together, and used it to his advantage. He ended up hiring a lawyer in the Houston area, and even her attorney was positively surprised about Mohamed’s preparation!

Mohamed’s strategy for the EB-2 NIW petition

General EB-2 requirement

Mohamed could qualify as Advanced Degree holder because even though he does not hold a Master or Ph.D. , he has a Bachelor and at least 5 years of progressive, post-graduation experience. In fact, he had well over 10 years of experience in the field, as mentioned above. In the interview he mentioned he also argued he was a person of Exceptional Ability because he could meet 5 out of the 6 regulatory criteria (only 3 are needed). However, as a note for our readers, only one route is necessary in this part of the petition. If one qualifies under the advanced degree route, they do not need to prove exceptional ability. The credentials for exceptional ability can be used to argue Prong #2 (well-positioned).

Prong #1: The proposed endeavor has Substantial Merit and National Importance

Mohamed’s background is in Finance and Business. More specifically, his endeavor was centered around fixing the supply chain issues. These problems are always important, but have been increasingly more prominent in the recent years. In his words, “when machines break down, they cause shut downs in entire plants while they are looking for the right part”. This, of course, is a huge economic problem for companies and for the country as a whole. He leveraged the experience he already had in this field during his years of work abroad. To highlight the National Importance of this endeavor, he used official White House documents such as President Biden’s executive order on fixing the supply chain challenges.
 

Prong #2: Well-positioned to advance the proposed endeavor

For this prong, Mohamed used different types of evidence, including (but not limited to):
 
  • Attendance to conferences, seminars… he used photos and e-mails proving he had been invited to participate
  • Business Plan. A plan shows the USCIS an applicant is well positioned because he knows what he will do in the US and how he will succeed in his endeavor.
  • Letters of recommendation. He had 2 independent letters and 4  subjective recommendations to show he is a reputable member of his profession.

Mohamed’s timeline for EB-2 NIW

Below are key dates on his success story case:
  • Started preparation of his petition: December 20, 2022
  • I-140 filing date (with premium processing): February 14, 2023
  • I-140 approval date: March 1, 2023
So, in summary, Mohamed received approval for his I-140 petition in just 15 calendar days. He did use Premium Processing, which guarantess a response (approval, denial, or RFE) in 45 calendar days for EB2 NIW.
 

Next step: adjustment of status

Mohamed will need to file an adjustment of status petition (I-485) to convert his B1/B2 visa into his newly approved green card. For now, he is waiting for his Priority Date to become current in the Visa Bulletin. As of March 2023, the Visa Bulletin date for EB-2 is December, 2022, so there are 2.5 months between the date on the visa bulletin and Mohamed’s priority date. Once his date becomes current, he will be able to file his petition to adjust status with USCIS and finish the process.

Mohamed’s advice to others

In our conversation, Mohamed offered some advice to EB2 NIW applicants that our readers may find useful:

  1. Do not listen to untrusted sources of information. There are many people out there and not everyone knows the subject well. Be careful about who you listen to, and trust your gut feeling.
  2. Identify your goal and evaluate if you qualify. You are the best person to determine if you can meet the requirements for this green card category.
  3. You can prepare by looking at a successful case. Mohamed downloaded my own I-140 petition to see how to craft a good petition. He compared his documents against mine to strengthen his application, understanding that each profile is different, but that there are ways to argue that are common to every case.
  4. If you use a lawyer, do not think they will replace you. You will need to work hard. Mohamed stressed out that putting together a strong petition means spending a lot of hours on the documents, and many sleepless nights. The lawyer is presenting your case, not replacing you.

Hand holding diplomaOne of the requirements for EB2 NIW green card is to have an advanced degree. In some cases, this can be substituted by other achievements such as experience or extraordinary abilities (check out this post to learn about all the requirements). 

Many petitioners hold MS or PhD degrees from non US countries. Regardless of the language spoken in those countries, an education credential evaluation is needed to show USCIS that your foreign degree is equivalent to a US degree.

What is a Evaluation of Education Credentials for EB2 NIW?

A credentials evaluation is a report by an acceptable evaluation agency that establishes the equivalency between a foreign college/university education degree and a US degree. Generally speaking, this type of report may be needed for the following instances:

  • Acceptance to education institutions
  • Employment
  • Professional certifications or licenses
  • Immigration processes
For EB2 NIW green cards, it is crucial to have the highest academic degree evaluated if this is foreign. This is true even if the degree was obtained in an English speaking country or institution.
 

The USCIS take on Evaluation of Education Credentials for EB2 NIW

It is always a great idea to go to the official source and check what the United States Citizenship and Immigration Services (USCIS) agency says about this type of report to understand the characteristics of what we need to obtain. The best resource to check in this case is the USCIS Policy Manual (Volume 6, Chapter 9) to understand what they expect.

These are the main takeaways from the official USCIS information about foreign degree equivalency reports:

  1. USCIS does not endorse any particular credential equivalency evaluation agency
  2. USCIS accepts reports from certain school officials 
  3. Reports should provide analysis and not only conclusions
  4. Equivalency reports are advisory only – the USCIS officer has the last word!

Where can you get a credential evaluation for your foreign degree?

As shown previously, USCIS does not provide a list or recommend any particular agency. In my personal case, I did not have to use one because my highest degree is from an American university. Therefore, I am unable to make a personal recommendation. However, from my exposure to the EB2 NIW community I can tell that World Education Services (WES) and International Education Evaluations (IEE) are two widely used organizations. A good way to find more options is to look inside the list of agencies that belong to the National Association of Credential Evaluation Services (NACES), a reputable American society that accepts evaluation agencies that meet certain standards.

What type of evaluation is needed for EB2 NIW?

A green card petitioner needs an evaluation of their highest academic degree relevant to the application. Even though one can opt for a detailed course-by-course description, all that is needed is a general evaluation that establishes what US degree is comparable to the foreign degree.

How to compare agencies and choose the right one for you

The two main factors: cost and time

The main two factors that I would consider when choosing an agency are cost and timeline. However, we will see that there are other factors to consider as well. In terms of cost, the two most popular agencies charge between $80 and $110 (as of late 2022) for the evaluation package that is enough for EB2 NIW application purposes.

Other factors: what documentation is requested by the evaluator

Beyond time and money, the documents required by the evaluators can also play a role in your decision. For example, one may accept copies of your transcripts and diploma, while another one may ask you for the originals, or even to send the transcripts from the university in a sealed envelope. In addition, some agencies may accept your documents in their original foreign language, while others may request the documents AND an accurate translation to English. 

As you can see, this type of consideration can influence the organization you want to choose especially if the costs and timelines are not so different. To facilitate your decision, here is the link to IEE’s documentation requirements, and here is the same for WES. For other agencies, please check their website or contact them to ask for this information.

 

Foreign degree evaluation for EB2 NIW: Conclusions

Evaluation of the highest degree (if foreign) is a must for EB2 NIW green card applications. While USCIS has some official guidelines in their Policy Manual, they do not endorse any particular evaluation agency. In this article, we review what type of evaluation you will need and what factors you may consider to pick a good evaluation institution.

However, the form relative to this PERM process needs to be enclosed in the I-140 petition together with the I-140 form, the cover letter, and all the attachments even for EB2 NIW.   In this blog post, we will discuss which form to use to satisfy this requirement and where to submit it to.

Why is the labor certification form required for EB2 NIW?

I can agree it does not make a lot of sense for USCIS to want this form. Since for the National Interest Waiver category there is literally no PERM process, this requirement seems odd at best. However, it may just be a bureaucracy-related oddity:

The NIW is an exception to the rule in that most of the other employment-based green card categories require a labor certification (done through the job sponsor with the Department of Labor, or DOL). Therefore, it makes sense that most green card petitions in the employment-based category need this labor certification form. Since NIW is just an exception, the form is also attached even if it is with much less information. More on this in the next section.

Which form to use: ETA-750 or ETA-9089?

I already received a few email from readers asking what to use. I always reply the same thing: I used ETA-9089. However, the USCIS website is clear in that both forms are acceptable as of September 2022. In the screenshot below, you can read the excerpt taken from the USCIS website for I-140 (link here) taken on 9/8/22:

According to this information, you have two options:

  1. Fill out parts J, K, L, and M or Form ETA-9089 (I wrote N/A on the rest of the form), OR
  2. Fill out ETA-750, part B.

Both of these forms can be found on the Department of Labor website, not USCIS! However, for the EB-2 NIW application, one of these should be sent to USCIS and not DOL as part of the I-140 application. The one of your choice should be included in duplicate.

That being said, I personally (and this is not legal advice!) prefer using ETA-9089 for the following reasons:

  • In the section Forms on the Department of Labor website, the ETA-750 form is listed under “Professional Athletes” program.
  • In the same section from the DOL website, form ETA-9089 is listed under the program Permanent (refers to Permanent Labor Certification), which makes more sense to me.

Can I use ETA-9089 if it is expired? (as of September 2022)

Something that was brought to my attention by a reader is that ETA-9089 seems to be expired. This refers to the “expiration date” listed on top of the form. The screenshot below (taken on 9/8/22) shows this clearly:

Of course, I was worried about this because we all know how important it is not to submit expired forms!

However, I contacted the Department of Labor on September 2022 and received a prompt response that I reproduce below.

In the email, they clearly say that “employers may disregard the expiration date “07/31/2021” specified on the Application for Permanent Employment Certification”. Note that generally this form is handled by the employers, hence their mention to them.

Form ETA-9089 (sections J, K, L, M) or Form ETA-750 (part B) should be enclosed in the I-140 petition to USCIS for the EB-2 NIW green card application, in duplicate.

Remember that the I-140 is not just the form, but the whole petition where you should prove you meet all the requirements for EB-2 NIW (National Interest Waiver). To show you comply with each requirement, you should provide the necessary evidence. A personal statement is often a good document to include in the exhibits along with other evidence. In this article, I will explain why and how you can go about drafting your own personal statement for EB2 NIW.

What is a Personal Statement 

A personal statement is a document drafted by the petitioner explaining the professional plans to pursue in the United States. It may seem redundant considering that part of the cover letter discusses the “proposed endeavor”. However, this plan can bring additional clarity to the USCIS officer. It can define the type of activity, beyond the endeavor, that one plans to undertake. In addition, the highlights of it can be quoted in the cover letter itself.

When is a good idea to include a Personal Statement for EB2 NIW?

A personal statement is a good idea for petitioners who are working professionals and not businesspeople or entrepreneurs. In other words, a personal statement or professional plan makes sense for a person who has been and/or plans to be an employee in an organization. For example, a scientist or researcher who has worked in academia or in a company. Or an engineer who works for companies developing products.

On the other hand, businesspeople or entrepreneurs may choose to write and attach a business plan instead, which can be more relevant to their occupations and provide more details to the USCIS officer. We will cover business plans in a separate blog post.

How to make a Personal Statement for EB-2 NIW

When writing a Personal Statement, the petitioner should be intentional since some excerpts from this document will be quoted in the petition’s cover letter. The structure of the personal statement can be the following:

  • Date
  • Salutation. Similar to the recommendation letters, it is courteous to include some sort of salutation to the USCIS officer that will review the document. “Dear Sir/Madam”, “Dear USCIS Officer”, “To Whom It May Concern”, are a few options.
  • Subject line. For example: “Personal Statement – Name and Last Name”
  • Petitioner´s background. This is just a summary of the profile of qualifications. It can be half or less than half of the document and it can serve as a reminder of how the person is well positioned in the field of endeavor.
  • Petitioner’s professional plans. In this part of the letter, the petitioner explains what the plans are for work in the United States, should a green card be granted. This should be at least half of the document. In the next section, I cover this part more in detail.
  • Name and signature. Don’t forget to sign in ink – it looks so much more professional!

How long should the Personal Statement be?

In my opinion, this document should be approximately 2 to 4 pages. Of course, each case is different and may require shorter or longer explanations. In general, you do not want to write too much that is completely boring to read. Too short personal statements could leave the USCIS officer thinking that there are no solid plans for a future in the US.

What to include in a Professional Plan for EB2 NIW

The petitioner’s professional plans can be broken down into sub-headers or paragraphs. A first paragraph can provide just an overview of the plans in the US, and then subsequent paragraphs can explain in detail different aspects. For example, a scientist or researcher can dedicate one paragraph to introducing the overall topic of investigation – let’s say process development for bioproducts. Then, there can be different sub-sections describing specific projects, such as “Production of biofuels from biomass residues”, and “Production of RNA for biopesticide uses”.

It is important to briefly link each project to its National (or international) Importance, to reinforce the idea that the endeavor is indeed linked to the United States’ interests.

Additionally, I suggest explaining in detail what type of job the petitioner is seeking, to articulate the work in the US better. If already in the US, the petitioner can talk about their current position (its relevance) and what type of organization it is. If there were already other job offers made, or recruiters approaching the petitioner, it is also interesting to mention them and add those as evidence in a suitable Exhibit. This can be additional evidence of how the petitioner is well positioned as there is interest in their services. All of this can be included in a separate subsection.

Wrap everything up by reaffirming how convinced you are that you will be able to easily find (or retain) the targeted job once you obtain the residency.

The value of the Personal Statement for EB2 NIW

The Personal Statement is useful to articulate the plans in the United States properly. This lets the USCIS officer know that the petitioner has a specific vision and plan to follow once in the US. This can help establish the second prong of the Matter of Dhanasar (the petitioner is well-positioned). In fact, the USCIS Policy Manual specifically talks about this type of document as one of the types of evidence that can be used for this prong: “A plan describing how the person intends to continue the proposed work in the United States”.

In conclusion: what should you do?

Like for other green card application matters, the decision is yours (and your lawyer’s if you use one). You know your case and can decide if a Personal Statement containing your professional plans can add any value to your EB-2 NIW application. If you think it can make your case stronger and clearer, then I would include it. In my case, I decided not to include a Personal Statement because there was little information to add through this document. You can download my real successful I-140 package here.

As for other types of green card petitions, EB2 National Interest Waiver (NIW) allows concurrent or separate I-140 and I-485 filings. In this article, we will learn what these two options are and what advantages or disadvantages they may present so you can use the one that best suits your case.

The steps of the EB2 NIW process

Unlike other employment-based green card applications, EB2 NIW does not involve a labor certification. This step is also referred to as PERM. This is a similarity to the also popular EB-1A green card category. Because of this, only two major steps are part of the green card application: the I-140 petition and the I-485 or adjustment of status or consular processing step if applying from abroad.

Concurrent or separate EB2 NIW steps

 Separate steps for I-140 and I-485

In this case, you would file your I-140 petition first, and once the United States Citizenship and Immigration Services (USCIS) delivers the approval you submit the I-485 petition for you (and your dependents if you have them). This is the route I followed in my own petition.

The advantages of filing separate I-140 and I-485 are:

  • The financial risk is limited to the I-140 cost. Currently, USCIS charges “only” $700 per I-140. This is much less than the fee for adjustment of status (currently $1,140 plus biometrics fee of $85 per person between 13 and 79 years old). If you file the I-140 and I-485 separately, you are only investing a smaller portion of the total cost. If the case is denied for some reason, that is the money you lose. However, if you file concurrently, you are “risking” a much higher amount. This is because the USCIS fees are non-refundable. I have a separate article breaking down all the costs of this green card category. Note: Filing from abroad through consular processing is cheaper than adjustment of status.
  • More than one I-140 filed. If you are trying for more than one green card category, you probably want to follow this route so you can see which one is successful before proceeding to the next step. This was my case, as I applied for EB2 NIW and EB1 at the same time. You can check out my YouTube video where I explain how I obtained approval for two I-140 petitions.

The disadvantages of filing separate I-140 and I-485 are:

  • Filing separately can be slightly slower than filing concurrently. This is because USCIS starts doing things like background checks or fingerprint collections while processing the I-140 petition. Here is a separate article discussing processing time.
  • The petitioner cannot request a Travel Document (advanced parole) or EAD cards for the dependents to work in the USA while waiting for the I-140 decision. In this case, because the adjustment of status has not been filed, one cannot request these documents that may be helpful for some. I have a separate article discussing traveling while the green card process is ongoing. One should be careful before leaving the US with a pending permanent residency petition.

Concurrent steps for I-140 and I-485

In this case, you would file both I-140 and I-485 petitions at the same time, or concurrently. You can only do this if there is a visa number available at the time of filing. In other words, you must check the visa bulletin to understand if you are “current”. This is based on your country of birth.

For example, lately, nationals from India and China have a considerable wait time before submitting the I-485 form (or proceeding with consular processing if abroad). If that is the case, concurrent or simultaneous filing cannot be done, and you would have to do the two steps separately, one after the other.

An exception to this is the cross-chargeability rule. This is a nice loophole to avoid long wait times if the spouse is from a country that is current in the visa bulletin. Then, the petitioner can use the spouse’s country of birth instead of theirs, and “skip the line”. If the spouse is current, then the I-140 and I-485 can be done concurrently. This is a nice solution for people to avoid backlogs!

The advantages of filing concurrent I-140 and I-485 are:

  • Slightly shorter processing time. Even though filing concurrently does not save a ton of time (theoretically the I-140 processing time is unaffected), USCIS does send notices for biometrics while I-140 is under processing. Additionally, background checks can also happen in that period. This may result in slightly shorter overall timelines.
  • EAD cards during the process. When filing concurrently, USCIS may provide EAD cards for the petitioner and dependents even before the I-140 is approved. This may be a positive aspect for many applicants and their families.
  • Travel Document during the process. Similar to the EAD cards, USCIS may issue the Travel Documents for Advanced Parole earlier compared to separate filings.
  • Avoid visa retrogression. Even though the visa bulletin should move forward, sometimes it does not. This is called visa retrogression. If there is a risk of visa retrogression, it may be a good idea to file concurrently to get ahead of the issue.

However, one must remember that if for any reason the petition fails, the EAD cards and Travel Documents will be lost. This is a reason why a petitioner and their family should carefully review their situation before traveling or using EAD cards for work. In some instances, consulting with an experienced attorney may help understand the situation better.

The disadvantages of filing concurrent I-140 and I-485 are:

  • More financial risk. While the government fee for I-140 is about $700 (as of 2022) and is only one for the main petitioner, the adjustment of status fee (I-485) is $1,140. When doing concurrent filing, one must pay both parts of the process at the same time. Since these fees are non-refundable, if the case is not approved the financial loss will be more pronounced. Particularly considering that dependents have to file and pay a separate adjustment of status form. If a case is submitted again, the fees will have to be repaid fully.

 

What is the best route for you? Should you file concurrent I-140 and I-485 or do separate filings?

Well, as for most green card-related questions, this is a highly personal and case-by-case decision. In this article, we reviewed the pros and cons of each option, and the final decision will depend on your particular situation and appetite for financial risk. In certain cases, it will be wise to consult with an immigration attorney that can provide legal advice on the matter.

The EB-1A and EB-2 NIW green card categories share similarities such as allowing self-petitioning and requiring high skill levels, but display some differences like wait times, different standards for requirements, or availability of premium processing. In this article, we discuss the EB1 vs EB2 NIW green card categories. By the end of this article, you should understand them and have the tools to decide on the strategy for your own case.

 

EB-1A vs EB-2 NIW : Similarities

These two categories are similar in that they allow self-petition (no job offer required), there is no labor certification step (which saves more than 1 year of processing time), and can be potentially cheaper than other options when not using lawyers.

Similarity #1: Self-petition

You can apply to both EB-1A and EB-2 NIW without the need for a job offer. This means that one can self-petition. In other words, a job offer is not required. This feature of both green card categories makes them very appealing to professionals who work in organizations that do not sponsor immigration petitions. In addition, they are a good avenue for people living outside the United States to obtain the necessary permits to immigrate.

Similarity #2: No labor certification

Because both EB-1A and EB-2 NIW allow self-petitioning, labor certification is not needed. 

Typically, in an employment-based green card petition, the process starts with labor certification (also known as PERM). During this PERM process, the company must show the Department of Labor (DOL) that there are no American workers willing and able to do the job. In addition, they should prove that they will pay at least the prevailing wage for the occupation. This is to ensure that the wages and working conditions of the existing US workers will not be negatively impacted by hiring an immigrant worker. 

This is a step that consumes months of processing time. The DOL typically issues the prevailing wage in 6 to 8 months. Then, the company tests the market for US candidates for at least 2 months. Finally, the PERM is submitted, and it takes about 6 months for DOL to process it. Of course, there is always a chance for audits or denials to happen, which would delay the timeline. This timeline also assumes no US worker meeting the criteria applies for the position. All in all, more than one year will pass before the PERM process comes to an end.

The flow chart below indicates the typical employment-based green card process. From the 3 typical steps, PERM is not necessary when filing for EB-1A or EB-2 NIW:

Similarity #3: Potentially less expensive process

Since EB-1A and EB-2 NIW green card applications can be self-petitioned, the applicants can decide if they use an immigration lawyer or not. Typically, the cost of the attorney fees is the highest among the total green card cost. In these two categories, the petitioner can still pay for that service and obtain professional help and advice. However, one can also prepare their own petition. In that case, the total cost of the whole process decreases from approximately $10,000 (with lawyers) to between $2,000 and $3,000 with a do-it-yourself (DIY) approach. Check out a very detailed breakdown of the costs for each case in this other blog post.

Similarity #4: Highly skilled individuals

Both the EB-1A and EB-2 NIW categories are a good fit for highly skilled professionals. This is because they require proof of extraordinary ability (EB-1A) or advanced degree or exceptional ability (EB-2 NIW). Only highly skilled individuals will realistically meet the qualifications.

Similarity #5: Benefit to the country

Both EB-1A and EB-2 NIW have requirements to show that the entry of the petitioner into the US will benefit the country. For example, for EB-1A the USCIS policy manual states that “the person’s entry must substantially benefit the United States in the future”. For EB-2 NIW the first prong of Dhanasar requires to prove that the proposed endeavor is of substantial merit and of national importance.

Similarity #6: Premium Processing for EB-1A and EB-2 NIW

While in the past Premium Processing was only available for EB1A and not for EB2 NIW, this is not the case anymore. Luckily, USCIS announced during 2022 that they were going to expand this expedited processing method to NIW cases. Finally, after a period of progressive implementation, Premium Processing will be available to all EB2 NIW applicants after January 30, 2023.

Even if USCIS finally approved Premium Processing for NIW, the expedited processing times will be different for EB-1A and EB-2 NIW. Submitting a request for Premium Processing for EB-1A results in a processing time of only 15 calendar days. For EB-2 NIW, however, the Premium Processing time will be 45 days. That is a full one month longer than for EB-1!

EB-1A vs EB-2 NIW : Differences

 Difference #1: Exceptional vs extraordinary abilities

The EB-1A category is a higher standard to meet by applicants than EB-2 NIW. This is because this green card category is reserved for those candidates who display what USCIS calls “extraordinary ability”. To prove this an applicant must provide evidence of the fulfillment of at least three out of ten criteria listed in their website

In EB-2 NIW the applicant may prove that they hold an advanced degree (master’s or Ph.D.) or show “exceptional ability“. So, when comparing EB-1A and EB-2 NIW one can notice that while EB-1A requires extraordinary ability, for EB-2 NIW an advanced degree may suffice provided that other requirements of the category are met. 

Only when the applicant does not hold an advanced degree, he or she must prove exceptional ability. To prove this, the applicant must show evidence of meeting at least 3 of criteria listed on the official website.  It is easy to notice how these criteria are generally easier to meet than those listed for EB-1A extraordinary ability. For example, while for EB-1A one criterium is “Evidence of your membership in associations in the field which demand outstanding achievement of their members, for EB-2 NIW there is a similar but less demanding criterium that asks for “Membership in a professional association(s)”.

Below are excerpts from the USCIS Policy Manual with specific definitions of extraordinary and exceptional ability, which illustrate the different levels the USCIS establishes for these two terms: 

Extraordinary ability (EB-1A): “is one of that small percentage who have risen to the very top of the field of endeavor.”

Exceptional ability (EB-2 NIW): “the beneficiary has a degree of expertise significantly above that ordinarily encountered in the sciences, arts, or business.”

Difference #2: Final Action Dates and Priority dates for EB-1A vs EB-2 NIW

Because EB-1A and EB-2 NIW belong to different employment-based green card categories, they are also listed in different rows on the visa bulletin. Generally, the wait times for EB-1A are equal to or shorter than for EB-2 NIW. For petitioners of many countries, this may not make a difference, since both categories may be current (no wait times to file adjustment of status). However, for other petitioners such as those born in India and China, the EB-1A category will be a shorter path to permanent residency.

In the example below (Visa Bulletin of August 2022) you can see how the final action dates for all countries for EB-1A are current. This means that someone with an approved I-140 can immediately file for adjustment of status (form I-485). However, not all the final action dates for EB2 NIW are current. For example, someone born in India can only file an I-485 if their priority date (listed in their notice of action for I-140) is earlier than January 2015. This is more than seven years of wait time compared to no wait if filing an EB1A green card! Do you have questions about how to read the Visa Bulletin? Should you apply for EB-1A or EB-2 NIW?

There is no magic answer to this question. Each case is different, and you need to carefully review the requirements of each category and make the best decision for your situation. Some factors to consider include:

  • Your profile of qualifications. The EB-2 NIW category has requirements that are generally “easier” to meet. However, there may be applicants with a profile strong enough to meet both the EB-1A and the EB-2 NIW criteria.
  • Your country of birth. If you think you qualify for both EB-1A and EB-2 NIW, it is important to look at the visa bulletin and figure out how long the wait time would be for you. For applicants from India and China it may make sense to consider EB-1A due to the long wait times for the EB-2 NIW category.

Can you apply for both EB-1A and EB-2 NIW?

Of course, you may always consider applying for both categories if you believe you have a decent chance in both EB-1A and EB-2 NIW. The reality is that a lot of the requirements overlap, and much of the write-up for one category can be used for the other one. The biggest effort is to adapt the petition cover letter to present your case in an optimized manner for each category.

Applying for both EB-1A and EB-2 NIW may increase your chances. Of course, it is more expensive to do this since you will be paying USCIS fees for both applications. However, it involves a financial risk of “only” $700 if you are applying for I-140 only, without concurrent adjustment of status.

Many may be wondering… but can I apply for two I-140 at the same time? The answer is yes. The I-140 for EB-1A and the I-140 for EB-2 NIW are independent and do not conflict with each other in any way. In fact, this is a similar route I followed when I applied for EB-2 NIW before the immigration attorneys from my company filed for EB-1B. I tell that story in a YouTube video that you can check out here.

Conclusions to EB-1A vs EB-2 NIW

The EB-1A and EB-2 NIW green card categories share similarities but display some differences, which we reviewed in this article. As a prospective petitioner, you should consider your own profile of qualifications, the requirements for each category, and your country of birth, before deciding on one category or the other. Finally, you can also consider applying for both categories if that is the strategy that makes sense for you.

In this article, we will cover one of the most frequently asked questions for researchers that are considering applying for this green card: how many publications and citations for NIW?

Do you need publications for NIW?

No, there is no official requirement for publications. This includes peer-reviewed publications, poster or oral presentations at professional conferences, and books or book chapters. Nevertheless, if you are a scientist, it will be easier for you to put together your petition if you can show a track record of publishing in your discipline.

Scientific PapersWhy can publications help you as a researcher?

Publications are not a requirement by USCIS but can help establish you are well positioned to advance the proposed of endeavor. This is one of the three prongs you must meet since the Matter of Dhanasar took precedentA USCIS policy manual gives includes the following as a type of evidence that can be used:

“Documentation demonstrating a strong citation history or the person’s work or excerpts of published articles showing positive discourse around, or adoption of, the person’s work”

Peer-reviewed publications can be especially useful to demonstrate that you are well-positioned because your work needs to undergo review by experts in the field before it is published. Then, citations to this work can further demonstrate its importance.

How many citations do you need for EB2 NIW?

The short answer is that there is no minimum number of citations needed. There is no requirement for citations in the USCIS EB2 NIW guidelines. This makes sense if you consider that this category goes beyond researchers. However, it is also true that, if you are a researcher, citations to your publications can help establish your authority in the field.

How can citations help you with EB2 NIW?

As a scientist or researcher, showing a citation record can aid in proving you are well-positioned to advance the proposed endeavor, one of the three prongs under the Matter of Dhanasar. Particularly, if we are talking about peer-reviewed publications. USCIS does mention that “a strong citation history of the person’s work” can be used as evidence to show that a person is well positioned.

How can you demonstrate the number of citations in your I-140 application?

As an applicant, you can include a screenshot of your Google Scholar profile where your publications and the number of citations are shown. Alternatively, you can use other platforms that offer similar functionality, like ResearchGate. You may want to include this as an Exhibit in your petition. You can check out how I went about showing my publication records in my own I-140 application.

The number of citations varies by field

Did you know that 44% of all published manuscripts never get citations? Just one citation for a scientific article may put you in the top half, and 10 will make you top 24%. In addition, if you are doing research, you may be very aware that different fields have different expectations for the number of publications or citations. Elsevier shows in this report data from Scopus that indicates that the field of Biochemistry, Genetics, and Molecular Biology has four times more citations than Arts and Humanities.

How can you prove the number and quality of publications in your petition?

The number of publications for EB2 NIW

To show the number of peer-reviewed publications, you may follow a similar method as for citations. You can take a screenshot of your Google Scholar profile and include it as an Exhibit in your petition. Of course, remember to refer to it in your cover letter! Moreover, you should consider adding at least the cover, if not a few pages, of each publication. You can create another Exhibit for your publications, and reference it in your cover letter.

The quality of your publications

Another important aspect is to speak to the quality of your publications. You can use two approaches here. The first one is to use quotes from recommendation letters where the recommender describes the significance of one or some of your articles. 

The second one is to use “objective” evidence to measure the quality of the journals where you published. As you may know, scientists use metrics such as impact factor to classify the journals. You can go to the journal’s homepage where they show impact factor, and take a screenshot that you can add in an Exhibit. Then you can include this information in your cover letter. However, it may be hard for the officer to understand how good the journal is solely based on this number. This is because they are not experts in your field. 

You can also find rankings of journals by discipline, and provide a copy of them as Exhibits in your petition. Then, you can use this information in your cover letter to argue that the journal you published in is relevant. There are two ranking resources I used in my own application:

  2. Google Scholar – link here

In both of these websites you can refine your ranking by field and sub-field. For example, for my particular discipline I can select Life Sciences as category and Biotechnology as sub-category. Then I can highlight the journal I published in (Bioresource Technology) and include this screenshot as evidence in the Exhibits section of my petition. In my cover letter I can refer to how Google Scholar considers this journal top 2 in the discipline. By association, having my work published in such a reputable journal is proof of how I am well-positioned.

What can you do if you do not have publications or citations?

There may be many reasons why you do not have publications or citations. Depending on the reason, a different solution may be available:

Reason #1: You are not a researcher.

Typically, publications are more typical of scientists and other researchers. If publications are not common in your field, you should not worry about this. This article is only for our audience of researchers.

Reason #2: You are too early in your career.

Maybe you just started your research career, and it is still too early to have peer-reviewed publications, or you just started publishing but you have not gathered enough citations. Present your case by comparing your citation number with the average citation number for articles of the same age in your disciplineThere are tools out there that can help you gather this information. Clarivate is one of them but unfortunately, it is a paid platform (you may check if your institution has access). 

You can also include a Research Plan as an Exhibit in your petition, so you can demonstrate you have ideas and a path to conduct research in the United States.

Reason #3: You do not work in academia.

If you are a scientist in a private organization, publishing may be not be an option. This is because oftentimes publishing hurt the chances for intellectual protection (IP). Take my case as an example: I published 7 peer-reviewed articles from my four years in Academia, but zero during 5+ years working in a company. And believe me, there were plenty of projects that generated publication-quality data! 

For this type of cases, you may want to use letters of recommendation to let others speak about your contributions to the field. For example, a senior employee at your organization can highlight your scientific achievements and even comment on the fact that publishing was not an option for IP reasons. 

Patents or patents applications are a type of publication that demonstrates your influence in the field. If you have some under your belt, you leverage them instead (or on top of) research publications.

Alternative types of evidence

This is a non-exhaustive list of alternative types of evidence you can leverage to compensate for the lack of publications or citations:

  • Letters of recommendation. Reference letters are a very versatile tool to help you build a strong case. In the case of low or no publications or citations, you may want to let others describe how important your contributions are. You can cite certain passages in your EB2 NIW cover letteand attach the reference letters to your application as Exhibits.
  • Awards, grants or scholarships. Awards for any accomplishment in the field can be an excellent demonstration of how well-positioned you are to advance your proposed endeavor. Similarly, being the recipient of grants or scholarships can show the USCIS officer you can achieve what you claim in your petition.
  • Patents, patent applications, invention disclosures. This type of intellectual property document can help demonstrate that you are an expert in the field.
  • Dissertations, thesis, conference papers, book chapters. Not only peer-reviewed publications are important. Any type of publication can be valuable for your EB2 NIW petition.
  • Research Plan. You may choose to add personal statement in the form of a letter to your I-140 application. This can give the USCIS officer a clear idea that you have thought your endeavor through and are positioned to advance it with a concrete plan of action.
 

Conclusions

Publications or citations are not a requirement for a successful EB2 NIW green card application. A high number of publications or citations can definitely help researchers, such as scientists, when putting together a case. However, there are alternative types of evidence one can use to compensate for the lack of peer-reviewed publications or low citation volume.

To obtain a National Interest Waiver, a petitioner should provide the evidence to fulfill the requirements. Under EB2 NIW the US government waives the need for a job offer to get a green card. However, one must prove to hold an advanced degree or show exceptional ability. Furthermore, the applicant should clearly explain why their endeavor is of substantial merit and is of National Importance.

The applicant writes a cover letter to guide the USCIS officer through all the documentation that supports the case. These documents are typically enclosed in the petition as Exhibits. Therefore, the EB2 NIW cover letter should be effective in providing a narrative to support the case for a National Interest Waiver. An effective cover letter should:

  • Be easy to understand without being an expert in the field
  • Reference all the important documents attached
  • Highlight the most critical aspects that support the case
  • Be organized according to the requirements for NIW for easy review

How to write an effective EB2 NIW cover letter

Plan before you write

Even before writing anything, as the petitioner, you should think about the case you want to make. In other words, dedicate some time to strategize about your I-140 petition. In the post about EB-2 NIW processing time I mentioned that 1 to 2 weeks is the time to dedicate to this planning stage.

What you want to do first is to update your CV with all your experience and skills. This will help you understand your own profile better. Then, focus on those items you think the I-140 petition should highlight. Consequently, you will understand what evidence you need to gather to support your case. In addition, you will better understand what evidence you need to collect through letters of recommendation. Typically, you leverage those letters to obtain evidence hard to substantiate through other means.

For example, imagine you are a scientist working in a private company and you could not submit papers for publication, so your organization did not lose intellectual property opportunities. In this case, you can have at least one recommender from your company describing in layman’s words what contributions you made.

What language to use in a EB2 NIW cover letter

…and I am not talking about English (duh!). Use very easy language that anyone can understand. You may be a nuclear physicist, an expert in virology, or perhaps a neurosurgeon. It does not matter how complicated your field is. You need to write about your endeavor and your achievements in a way that even your family could understand. Think that the USCIS officer may not an expert in any technical field! (Other than in green card applications, of course).

In addition, remember that the officer has limited time. You should make his or her life easier by going to the point and avoiding unnecessary repetition. Just put yourself in their situation: imagine you are slammed by a multiple hundred-page package to review in a limited time. The EB2 cover letter should really be quick to go through so all the evidence is well articulated and a decision can be made relatively fast. By not helping the officer and making the document too long, you are hurting your own case! He or she may get bored and lose interest, or perhaps think that if you are repeating the same things over and over you do not have the qualifications that you claim to have.

Quotes and Exhibit references

Remember that the cover letter is only a guide for the USCIS to understand your case effectively. You will provide all the evidence as Exhibits. In the cover letter, you will quote excerpts from letters of recommendation, or other documents, as needed.

Structure of EB2 NIW cover letter

The following structure for the cover letter can be helpful to articulate the case in an effective way:

  1. Letter Introduction – very short summary of each section in the cover letter
  2. Table of Contents – an index with page numbers
  3. Chapter 1: Advanced Degree or Exception Ability Section
  4. Chapter 2: Substantial Merit and National Importance
  5. Chapter 3: I am Well Positioned to advance the proposed endeavor
  6. Chapter 4: It would be beneficial to the USA to waive the Labor Certification
  7. Petitioner’s nonimmigrant status
  8. Petitioner’s dependents status
  9. Conclusions

1. Cover Letter Introduction

In this section, you will address the USCIS offer and introduce them to your petition. This section contains basic information on the top, such as:

  • Date 
  • USCIS address (check the right USCIS address in the official website)
  • Subject line, for example “RE: EB-2 Immigrant Petition for Permanent Residency with National Interest Waiver”
  • Petitioner name, type of submission (Original submission), classification sought (Immigration and Nationality Act 203(b)(2)(B))

Then, you can write a short letter to the officer introducing yourself. First, you can simply state you are pursuing approval for the Immigrant Petition for Alien Worker (I-140) as a self-petitioner/beneficiary and that you would like to demonstrate your fulfillment of the EB-2 National Interest Waiver requirements and provide evidence to support it.

Next, you can tell the officer that you are eligible for EB-2 classification as either an Advanced Degree Holder, or due to your Exceptional Ability. Here you can cite Section 203(b)(2) of the Immigration and Nationality Act, 8 U.S.C. §1153(b)(2) as the regulation of reference. You can specifically state what Advanced Degree you hold, or what three criteria you fulfill for exceptional ability. You can reference Chapter 1.

In the next paragraph, you can state that you will be providing further evidence to demonstrate that a waiver of the labor certification is in the national interest, pursuant to the precedent case Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016). Interim Decision #3882. You can reference Chapter 2.

Finally, you can provide three short paragraphs, each one addressing Chapters 3, 4, 5. These are the justifications for why the proposed endeavor has substantial merit and national importance, why you are well-positioned, and why it would be beneficial to waive the labor certification. In each paragraph, you can reference the appropriate Chapter.

You can remind the USCIS officer that there are Exhibits under the letter, and can provide them as a bulleted list.

2. Table of Contents

The table of contents is exactly what the name suggests: and index with Chapter titles and subsections with page numbers.

3. Chapter 1 – Advanced Degree or Exceptional Ability Section

If you are an advanced degree holder this will be a very quick Chapter. You only need to state what type of degree you hold (M.S., or Ph.D., for example), the institution, and reference to the appropriate Exhibit number. It is wise to provide a short explanation of how this degree is related to the endeavor you are going to be discussing later in the document.

If you do not have an advanced degree, you will state that you are a person of exceptional ability and provide the reasons. Then, create subsections to address each of the (at least three) categories that you meet. For each of them, remember to refer to the appropriate Exhibit containing the evidence. This evidence may be Letters of Recommendation, educational degrees, or proof of membership in professional associations, to name a few.

You can finish this Chapter with a statement saying that you qualify for EB-2 classification as either a member of the professions holding an advanced degree or a person who has exceptional ability.

4. Chapter 2 – Substantial Merit and National Importance

In this chapter you will explain in detail what endeavor you will pursue as a worker in the United States. In addition you will specify why this endeavor is of substantial merit and of national importance. First of all, remember that endeavor is not just a general occupation. USCIS restricts the definition as the details of what this occupation involves specifically.

Second, substantial merit is a broad term that could mean multiple things; anything of intrinsic merit. Third, national importance is more restrictive. This is because you need to prove the endeavor is relevant for the US as a whole. In other words, it cannot impact only part of the country! We covered this in a separate blog post about how to qualify for National Interest Waiver.

You should start this chapter by clearly identifying the endeavor and the impacts on the United States. In addition, specify the type of work you do to advance this endeavor. Then, you can break down this chapter into subchapters to explain the benefits of the endeavor for the US. For example, in my case, I used “Bioprocessing to generate biofuels and bioproducts” as my endeavor. Then, I had different subsections:

  • Brief introduction to the field
  • Impact on Food Safety and Security
  • Impact on Energy and National Security
  • Summary of benefits to the nation

In each of these sub-sections, I used quotes from the Exhibits to prove substantial merit and national importance. These quotes were taken from the recommendation letters and from documents from the US government. Typically, you want to demonstrate National Importance using published documents from Congress, or the White House, or some government agency. You want to connect the dots between your experience (and endeavor) and what the US government considers strategic. This makes your case very strong! In the post about how to qualify for NIW I gave a few links that may be useful for this. Alternatively, you can also find references in the scientific literature that speak to the dimensions of a certain problem you can help solve. Finally, excerpts from reference letters can help bring these points home.

Example from sample EB2 NIW cover letter

According to the US Energy Information Administration, 63% of the energy consumed in the country in 2013 was produced from petroleum and natural gas. According to BETO’s website, this federal office aims to “work with a broad spectrum of government, industrial, academic, agricultural, and nonprofit partners across the United States to develop commercially viable, high-performance biofuels, bioproducts, and biopower made from renewable U.S. biomass resources that reduce our dependence on imported oil while enhancing energy security.”. (Exhibit 9B: Relevance of research for the U.S. National Interest – Screenshot of BETO website). It is evident that the field of bioprocess engineering, specifically bioenergy and biofuels, is a top priority for the U.S. government.

5. Chapter 3 – I am Well Positioned to advance the proposed endeavor

This is another central section of the cover letter, in which you must describe your achievements in detail. This is because you need to establish how you are well-positioned. You have to do it in a methodical way and always reference the documents attached as Exhibits. Remember that every claim needs supporting evidence.  Below is the structure I used for my third Chapter. Each of the bullet points were sub-headings in my cover letter.
[Please keep in mind that this is just a sample letter structure, and you can use a different structure if it fits you better. There are no guidelines by USCIS on how to do this. You may have additional (or less) qualifications or experience that may need a different approach.]

  • Background and achievements.
  • Summary of qualifications. After reminding the officer about my advanced degree, I went on to provide additional qualifications. You can provide proof of being a member of professional associations, peer-review publications, and citations (for scientists), and quote certain relevant passages from recommendation letters.
  • Specific exceptional contributions to the field. I broke them down by project I worked on. I included specific evidence showing the impact my work had had in the broader field. Since I am a scientist I provided evidence of the publications that my work produced (including the number of citations) and statements from the reference letters.
    • Project 1
    • Project 2
    • Project 3…
  • Evidence of the influence of my research. This is more specific to scientists, but other professions can use a similar sub-section adapted to the field. For scientists, you can use your Google Scholar profile to show your publications and how many citations you received.
  • Review work from peers in international journals. This one is also specific to researchers. But other professions may have alternative ways to demonstrate that they judge the work of others. For example, you may have participated in competitions as a judge, may have been a member of hiring panels, or may have overseen the work of others and participated in their performance reviews. Be creative in finding evidence that shows you are a reputable member of the profession.
  • Commanding a higher salary. You may choose to include this as part of your demonstration of exceptional ability, which may help establish how you are well-positioned in the field. A good way to demonstrate this is to compare your salary/compensation with those shown in CareerOneStop, a portal by the US Department of Labor, for similar positions. Additionally, you can use other sources of information.
  • Conclusions to Chapter 3. A short statement reiterating that you are well-positioned to advance the proposed endeavor.

For this chapter, you can include a Personal Statement letter as an Exhibit. Alternatively, if you are an entrepreneur, you may provide a Business Plan (you can find examples here).  These are especially useful if you are not currently working in the United States. You can use this letter for Chapter 3 (proving you are well-positioned) and for Chapter 4 (waive the Labor Certification). We will cover Personal Statements in a different blog post. But until then, you should know that this type of statement may be a 1 to 4 page letter where you briefly describe your background and spend most of the letter explaining plans for your work once in the United States.

6. Chapter 4 – It would be beneficial to the USA to waive the Labor Certification

In this Chapter, generally shorter than the previous two, you can explain why the US should waive the Labor Certification. You can do this in different ways.

First, you can remind the USCIS officer that a labor certification considers only minimum requirements but not exceptional abilities. Here, you can briefly reiterate why your achievements are exceptional. You may refer to previous Chapters and even bring new quotes from reference letters to convey the message.

Second, if you are already working in the United States, you can provide evidence that your organization needs you. Consequently, by extension, you are needed in the country. You can briefly explain again that your work is critical for the nation and finding another professional in the field with similar contributions is extremely difficult. 

In addition, you can literally state that your exceptional skills and track record of achievements cannot be articulated in a labor certification process. This is because this process would lead to choosing a person with weaker skills and experience than you have. During this section, it would be immensely helpful if someone in your organization had provided a letter of recommendation, that can be quoted.

If you are not currently working in the US, you refer to a EB2 NIW Personal Statement letter or a business plan, to help argue the need for waiving the labor certification.

7. Petitioner’s nonimmigrant status

In this section, you can briefly describe your current status as a nonimmigrant in the United States. Of course, this applies only if you are already in the US and not if you are applying from abroad using Consular Processing. Remember to attach the pertinent documentation to the Exhibits section. This includes copies of visas, EAD cards, passport, I-94…  

8. Petitioner’s dependents status

Even though the I-140 petition is centered on you, it is necessary to mention that you have dependents if that is the case. This is because in case you are granted a green card, they will also be eligible for it.  In this section, you can describe what is their nonimmigrant status and reference the appropriate Exhibit where their documentation is.

9. Conclusions

This section is self-explanatory. In approximately one page, summarize all the Chapters of the EB2 NIW cover letter and wrap it up with a final call for the USCIS officer to consider your petition. Remember to thank them for the time they put into reviewing your case! Tip: Adding your signature in ink at the bottom makes the letter look more formal.

After the writing process: proofread

As for every part of the I-140 petition, you should invest a considerable amount of time going through what you wrote. This is a central part of the petition and you want to make sure there are no grammar issues, typos, or errors referencing the Exhibits. For grammar checks, I use the tool Grammarly. They have a free plan that integrates well in apps like Microsoft Word. Additionally, you can upgrade to a paid plan for extra functionalities. In addition to using this type of tool, you may share your cover letter with a friend or colleague to get a second review. They can even provide feedback on how easy it is to understand, especially if they are outside your professional field.

How long should the EB2 NIW cover letter be?

There are no official rules about how long the EB-2 NIW cover letter should be. Typically, letters of 10 to 40 pages are common. Considering the amount of evidence that an EB-2 NIW case includes, it is hard to think shorter letters can be effective. It is likely that the USCIS officer misses some evidence because the content was condensed too much. On the opposite side, a cover letter that is too lengthy may be repetitive and boring. My EB-2 NIW cover letter was 22 pages long. In hand sight, I think I could have made it a bit shorter by avoiding unnecessary repetition.

The EB-2 NIW cover letter: closing comments

Follow a structure that matches the requirements for this green card category, so it is easy to review for the USCIS officer. Use language easy to understand and avoid repetition.
